BCS Environmental Ltd – Terms of Service
These Terms and Conditions govern all services provided by BCS Environmental Ltd (“we”, “us”, “our”, or “Service Provider”). By accepting a quotation or allowing us to begin work, you (“you” or “Customer”) agree to these Terms.
Application and entire agreement
These Terms apply to all services detailed in our quotation (the “Services”). Together with our quotation, they form the entire agreement (“Contract”). You confirm you have not relied on any other representations or statements outside of the Contract.
Services
We will provide the Services with reasonable care and skill, following the specifications in our quotation. Adjustments may be made to comply with safety or legal requirements.
Due to the nature of asbestos services, reasonable access may require alterations to building structures and could cause decorative damage, for which we are not liable. Additional costs caused by unforeseen circumstances beyond our control will be invoiced separately.
We will make reasonable efforts to complete work on time, but deadlines are not guaranteed.
Customer obligations
You must provide all required permissions, licences, and access to property and information. Non-essential mechanical and electrical connections must be isolated before our arrival, and all work areas must be cleared. Failure to comply may lead to delays, termination, or additional costs.
Fees and payment
Fees are fixed as per the quotation and exclude main contractor discounts or retentions unless stated.
You are responsible for reimbursing expenses such as travel, accommodation, third-party services, and materials required for the Services. Additional work will be charged separately. Quotations are valid for 14 days.
Invoices will be issued upon completion or in line with agreed milestones. Payment terms are stated on invoices or as otherwise agreed. Late payments will incur a £100 fee and 8% interest above the Bank of England base rate. Services may be suspended or cancelled for non-payment.
Cancellation
Cancellation charges apply as follows:

Within 48 hours of project start: 50% of total contract value

Within 24 hours of project start: 65% of total contract value

On the project start day: 100% of total contract value
Amendments to Services must be requested in writing; additional costs may apply.
Subcontracting and assignment
We may subcontract or transfer rights or obligations without notice, provided your rights are not affected. You may not transfer or assign your rights without our written consent.
Termination
We may terminate Services immediately if you breach these Terms materially, fail to make payment, or become insolvent or enter administration, liquidation, or similar proceedings.
Intellectual property
We retain copyright and intellectual property rights in all goods, materials, and deliverables. You may not copy, reproduce, or use them beyond agreed purposes without our written consent.
Liability and indemnity
Our total liability under these Terms is capped at the total Fees paid by you under the Contract.
We are not liable for indirect or consequential losses, including loss of profit, data, or reputation, or for delays caused by events outside our control. We are also not liable for losses caused by your failure to meet obligations or by misuse of our deliverables.
You must indemnify us for any damage to our equipment caused by you, your agents, or your employees.
Nothing in these Terms excludes liability for death or injury caused by negligence, fraud, or other matters where exclusion would be unlawful.
Data protection
We comply with UK GDPR and other data protection laws. Personal data will be processed only as necessary, stored securely, and shared only with authorised personnel or subcontractors.

Circumstances beyond control
We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, terrorism, or government actions. If disruption lasts over 90 days, either party may terminate the Contract.
Communications
All notices must be in writing and will be considered delivered upon receipt, email confirmation, or after 5 business days if sent by mail.
No waiver
Failure to enforce a right under this agreement does not constitute a waiver of that right.
Severance
If any clause is deemed unenforceable, the remaining provisions will remain valid.
Governing law
This agreement is governed by the laws of England and Wales, and disputes will be resolved exclusively in the courts of England and Wales.
